TODAY: ICE RAIDS FROM LA to SEATTLE

ICE Raids are being conducted today by the department of homeland security. Here are some things to keep in mind.

ICE Raids: Know Your Rights

We have heard rumors that ICE may be engaging in raids next week in certain “sanctuary” cities across California, including San Francisco. WE DO NOT KNOW FOR CERTAIN if this will happen but to be safe, we want to tell communities to be extra cautions next week.

***In particular, remind the community that they have rights:

  1. Do NOT open doors to any officials unless they have a warrant signed by a judge. If ICE says that they have one, do not open the door to see it, have them pass it under the door.
  2. If you are confronted with an ICE agent – remain SILENT. You have the right to remain silent and ICE can use anything that you say against you in your immigration case. Also, DO NOT SIGN anything that ICE gives you.
  3. If you hear about ICE agents coming to anyone’s door – tell your neighborsText and call people to let them know that ICE is in the neighborhood. Tell them not to open their doors and to remain silent.
  4. HAVE A PLAN of action if a loved one is detained. Have the name of a trusted immigration attorney on hand. Have a plan for who could take care of minor children. Remember that if detained, you may be able to fight your case and get bail.
  5. Be ESPECIALLY CAREFUL IN THE MORNING. In our experience, raids happen more frequently in the morning, e.g. around the time that people go to work.

Class Action Law Suit

Are your parents legal residents but you never got your papers? You may be covered by a nationwide class action lawsuit pending in the Ninth Circuit.

Description: Image removed by sender. For several years now, we’ve done the hard work of keeping our politicians accountable, leaving no stone unturned in the fight for our rights. We’ve occupied Congress with our demands for justice, and confronted ICE on multiple occasions in multiple states. Our work has directly changed the course of the immigrant rights movement. Now we’re stepping it up and taking our fight to court.

The Ninth Circuit has agreed to re-hear the Child Status Protection Act (CSPA) nationwide class action litigation, De Osorio v. Holder. This case, in small part, addresses the issue of immigrant youth who’ve grown up in the United States with or without papers and have parents who are legal permanent residents.

It’s a complicated legal matter but the gist of it is that if your parents got their green-cards through their relatives (their parents or siblings) or an employer sponsor, but you didn’t because you turned 21, there may be a chance that you can adjust your status to that of a green-card holder if the Ninth Circuit rules in our favor. The Fifth Circuit has already ruled in our favor. If we win in the Ninth Circuit, thousands of young adults will be eligible for green-cards. Hundreds of undocumented youth would no longer be subject to detention and deportation away from their own homes and families.

As such, we need your stories for an amicus brief we are filing with the Ninth Circuit next week to highlight the plight of immigrant youth across the country and tell the court that we have a vested interest in this matter.

Please reply to this email, no later than this Sunday at 11:59 pm, if you think you may qualify and are willing to share your story for this. If you have privacy concerns, you can offer your story while remaining anonymous and your name can be redacted from the record and we can also use an alias of your choice.

HEALTH COVERAGE FOR PRE-EXISTING CONDITIONS

California’s Pre-Existing Condition Insurance Plan offers health coverage to medically uninsurable people who have been rejected by commercial insurers or offered coverage at unaffordable prices.

As part of the national health reform package, California has a contract with the U.S. Department of Health and Human Services to establish a federally funded high-risk pool program to provide coverage for eligible applicants.

This insurance option stops on Dec. 31, 2013 once the entire national health reform program begins and federal laws go into effect to prevent insurers from denying pre-existing conditions or charging them higher rates.

But until that day arrives, people enrolled in the state plan will be covered for inpatient and outpatient care, doctor visits, preventative care, prescriptions, mental health services, x-rays, pregnancy care, durable medical equipment and more.

To be eligible, requirements include:

U.S. citizenship
Must be uninsured for at least the last six months.
Must have a pre-existing condition and within the last 12 months have been denied individual health insurance coverage or offered/charged premium rates higher than the rates offered by the California Major Risk Medical Insurance Program preferred provider organization.
